1. Introduction

Welcome to the Beacon technology platform and professional ecosystem (the “Platform”), owned and operated by Updawg Inc., a Delaware corporation, branded and publicly marketed as “Beacon” (“Updawg,” “Beacon,” “we,” “us,” or “our”). The Platform includes the website located at https://beaconnection.com, any associated mobile applications available for Apple iOS and Android devices (the “Beacon App”), and any successor URLs or applications. For the avoidance of doubt, all data practices described in this Privacy Policy are those of Updawg Inc.

Your privacy is important to us, and we are committed to protecting your personal information. This Privacy Policy describes how we collect, use, share, and protect your information when you visit or use the Platform and our related services (collectively, the “Services”). This Privacy Policy applies to all users of the Platform, including Referrers, Service Providers, Prospects, and visitors (each as defined in our Terms of Service).

This Privacy Policy should be read in conjunction with and is governed by our Terms of Service. Capitalized terms not defined in this Privacy Policy have the meanings given to them in our Terms of Service.

“Personal information” means any information that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, consumer or household.

2. Your Consent

By using the Platform, you consent to the collection, use, and sharing of your personal and other information as described in this Privacy Policy.

Where required by applicable law, we will obtain your prior consent before processing your personal information for purposes beyond what is necessary to provide the Services or not otherwise set forth in this Privacy Policy. You may withdraw your consent at any time by contacting us using the information provided in Section 18 below; however, withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

3. Information We Collect

We collect personal and other information in several ways depending on how you interact with the Platform.

3.1 Information You Provide Directly

You may provide personal and other information when you create an account, submit referrals, post content, complete forms, or otherwise interact with the Platform. This may include:

  • Contact information (name, email address, phone number, mailing address);

  • Professional information (job title, company name, industry, professional biography);

  • Account credentials (username, password);

  • Tax and identity documentation (e.g., Form W-9 or equivalent);

  • Company information submitted by Service Providers (firm name, service offerings, prospective client profiles, practice areas);

  • Job postings and associated details (where applicable);

  • Communications you send to us (support requests, feedback, survey responses); and

  • Any other information you choose to provide, subject to applicable laws and this Privacy Policy.

3.2 Referral Activity Data

When you use the Platform to submit, receive, or participate in referrals, we collect data specific to that referral activity (“Referral Activity Data”). This includes:

  • The identity of the Referrer, Service Provider, and Prospect associated with each referral;

  • The nature and status of each referral (e.g., submitted, meeting scheduled, meeting completed, deal in progress, deal closed);

  • Meeting details (date, participants, outcome as reported by participants);

  • Deal details (engagement type, approximate value, start date, status);

  • Compensation information (amounts earned, payment status, payment history); and

  • Communications and notes related to referral activity exchanged through the Platform.

Referral Activity Data is used to facilitate the Platform’s core services, verify triggering events for compensation, enforce the Terms of Service (including non-circumvention and Platform exclusivity provisions), and improve the quality of referrals.

3.3 Information from Third-Party Data Providers

To improve referral quality, validate information, and enhance the Platform experience, we may obtain information about you from third-party data providers, including:

  • Professional and employment information (current and prior job titles, employer, industry, seniority level);

  • Company affiliation and firmographic data (company size, revenue, industry classification, geographic footprint);

  • Professional networking profiles (e.g., LinkedIn profile information that is publicly available or accessible through authorized data partnerships);

  • Contact information (email addresses, phone numbers, business addresses);

  • Company intelligence (recent fundraising activity, growth indicators, hiring trends, open positions, leadership changes); and

  • Other publicly available business information relevant to referral matching.

We may enrich data associated with all user types on the Platform, including Referrers, Customers, and Prospects. We do not sell enriched data to third parties. For avoidance of doubt, Updawg does not act as a “data broker.”

When we receive personal information from third parties, we implement controls designed to help ensure that such information is obtained from reputable sources and is collected and shared in compliance with applicable law.

3.4 Information Collected Automatically

When you access the Platform, we and our third-party service providers may automatically collect:

  • IP address and approximate geographic location;

  • Browser type and version, operating system, device type, and screen resolution;

  • Pages visited, features used, links clicked, and time spent on the Platform;

  • Referring URL or source that directed you to the Platform;

  • Device identifiers (including advertising identifiers on mobile devices);

  • Information collected through cookies, web beacons, pixel tags, and similar tracking technologies (see Section 7); and

  • Statistical identifiers and device recognition data.

3.5 Mobile Application Data

If you access the Platform through the Beacon App, we may additionally collect:

  • Device identifiers unique to your mobile device (e.g., IDFA, Android Advertising ID);

  • Push notification tokens (if you enable push notifications);

  • Device model, operating system version, and mobile carrier information;

  • App usage data (features accessed, session duration, interaction patterns);

  • Crash logs and diagnostic data; and

  • Location data, if you grant the app permission to access your device’s location services.

The Beacon App does not access your device’s contacts, camera, photos, or other sensitive device features without your express permission.

3.6 Payment Information

When you make or receive payments through the Platform, payment transactions are currently processed by Stripe, Inc. (“Stripe”). See Stripe’s Privacy Policy. We do not collect, store or have access to your full payment credentials. We may receive limited transaction information (e.g., last four digits of a payment card, transaction amounts, dates, payment status) for record-keeping, invoicing, and reconciliation.

4. How We Use Your Information

4.1 Providing and Operating the Platform

  • Creating and managing your account;

  • Facilitating referrals, introductions, and meetings between Referrers, Customers, and Prospects;

  • Tracking referral status, meeting outcomes, and deal progress;

  • Processing and distributing payments, including verifying triggering events for Referrer compensation;

  • Matching Referrers with relevant referral opportunities;

  • Matching Customers with qualified Prospects; and

  • Providing customer support and responding to inquiries.

4.2 Data Enrichment and Referral Quality

  • Enriching user profiles with professional and firmographic data;

  • Validating contact information and professional credentials;

  • Identifying ideal customer personas and decision makers;

  • Analyzing company intelligence (fundraising, growth, hiring trends); and

  • Enhancing the accuracy and completeness of the Platform’s data.

4.3 Platform Improvement and Analytics

  • Understanding how the Platform is used and identifying areas for improvement;

  • Conducting internal analytics and research;

  • Aggregating and anonymizing data for statistical analysis; and

  • Customizing content, layout, and recommendations based on usage patterns.

4.4 Compliance and Enforcement

  • Enforcing our Terms of Service, including non-circumvention, non-solicitation, platform exclusivity, and payment corrections and clawback provisions;

  • Detecting, investigating, and preventing fraud, duplicate referrals, and unauthorized activity;

  • Verifying user identity, tax documentation, and payment eligibility;

  • Complying with applicable laws, regulations, and legal processes; and

  • Protecting the rights, property, and safety of Updawg, our users, and the public.

4.5 Communications

  • Sending transactional communications related to your account and referral activity;

  • Sending administrative notices and Platform updates; and

  • Sending marketing communications or announcements, from which you may opt out at any time. We do not send marketing communications via SMS/text.

5. How We Share Your Information

5.1 Sharing Among Platform Users

The Platform is designed to facilitate introductions and referrals, which inherently requires sharing certain information among users:

  • Referrer Identity. When a Referrer submits a referral, the Referrer’s name and identity will be visible to the Customer associated with that referral.

  • Prospect Information. When a Referrer introduces a Prospect to a Customer, the Prospect’s name, contact information, and relevant professional details will be shared with the Customer.

  • Customer Information. Customer names, service offerings, and relevant business details are shared with Referrers.

  • Referral Activity Data. Referral status, meeting details, and deal progress may be shared among parties involved in a referral. Individual Referrer compensation terms and payment amounts are treated as confidential between Beacon and the Referrer.

5.2 Service Providers and Processors

  • Payment processors (currently Stripe);

  • Third-party data providers for data enrichment services;

  • Cloud hosting and infrastructure providers;

  • Analytics providers;

  • Email and communication service providers;

  • Customer support tools; and

  • Tax and compliance service providers (e.g., for 1099 issuance).

5.3 Legal and Compliance Disclosures

We may use or disclose your information if we have a good faith belief that such use or disclosure is reasonably necessary to comply with legal process, prevent wrongdoing, or protect our rights, reputation, property, or that of our users, affiliates, or the public.

5.4 Business Transfers

If Updawg or any of its businesses are sold, merged, reorganized, or disposed of, your information may be among the assets transferred and will be subject to the promises made in any pre-existing Privacy Policy.

5.5 Aggregated and Anonymized Data

We may share aggregated or anonymized information that cannot reasonably identify you for research, analytics, benchmarking, or other internal business purposes.

5.6 With Your Consent

We may share your information with third parties when you have given us your express consent to do so.

5.7 No Sale of Personal Information

We do not sell your personal information to third parties for their direct marketing purposes. See Section 12 for U.S. state privacy rights.

6. Data Enrichment Practices

6.1 Purpose

We enrich user and company data to improve referral quality, validate professional information, identify ideal Customer-Prospect matches, and ensure that introductions are relevant and timely.

6.2 Scope

Data enrichment may apply to all user types. For Prospects who have not yet created a Platform account, enrichment is limited to professional and business information from publicly available sources and authorized partnerships. We do not obtain sensitive categories of personal information (e.g., health or financial information) from authorized third-party data providers.

6.3 Your Rights Regarding Enriched Data

You have the right to access, correct, or request deletion of enriched data associated with your profile, subject to the rights and limitations in Section 12.

7. Cookies, Tracking Technologies, and Analytics

7.1 Cookies

Neither the Platform nor the Beacon App deploy cookies or other tracking technologies. However, we use Microsoft’s Entra ID (formerly Azure Active Directory) for user authentication, security, and session management. Entra ID uses third party persistent and session cookies to enable Single Sign-On. Disabling them will likely break SSO functionality. We do not use cookies to serve targeted ads.

7.2 Web Beacons and Pixel Tags

We may use web beacons, pixel tags, and similar technologies in the Platform and in emails to determine whether a page has been viewed or an email has been opened.

7.3 Analytics

We use analytics services, including Google Analytics, to collect information about your use of the Platform. You may opt out via the Google Analytics Opt-Out browser add-on.

7.4 Do Not Track

Because there is no widely accepted standard for how to interpret DNT signals, the Platform does not currently respond to DNT signals.

8. Geolocation

If you access the Platform through a web browser, you may be asked whether you want us to access your geographic location. You may revoke this consent through your browser or device settings at any time. If you access the Platform through the Beacon App, location data collection is governed by your device’s permission settings.

9. Data Security

We implement reasonable administrative, technical, and physical security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit, access controls, and regular security assessments.

BE ADVISED THAT NO DATA TRANSMISSION OVER THE INTERNET OR ANY WIRELESS NETWORK CAN BE GUARANTEED TO BE 100% SECURE. While we strive to protect your personal information using commercially available and industry-standard security measures, we cannot ensure or guarantee the security of any information you transmit to us, and you do so at your own risk.

If we determine that your personal information has been or may reasonably have been compromised, we will notify you in accordance with applicable law.

10. Data Retention

We retain your personal information for as long as your account is active, as necessary to provide the Services, or as required to fulfill the purposes described in this Privacy Policy. Referral Activity Data may be retained for the duration of any applicable survival periods under the Terms of Service. Upon request, we will delete your personal information from our active systems, subject to legal exceptions. Backup data will be passively deleted as backup files are recycled.

11. Information Regarding Prospects

Prospects are individuals or companies introduced to Customers through the Platform by Referrers. In some cases, Beacon may collect, enrich, and share publicly available information about Prospects before the Prospect has created a Platform account. Prospect information is used solely for facilitating qualified referrals and introductions and is not sold to third parties. Prospects may contact us at any time to access, correct, or request deletion of information associated with them.

12. Your Rights and Choices

12.1 General Rights

  • Access: request access to the personal information we hold about you.

  • Correction: request correction of inaccurate or incomplete personal information.

  • Deletion: request deletion, subject to certain legal exceptions.

  • Portability: request a copy of your personal information in a structured, machine-readable format.

  • Opt-Out of Marketing: opt out at any time via the unsubscribe link or by contacting us.

  • Opt-Out of Data Enrichment: request that we cease enriching your profile with third-party data.

To exercise any of these rights, contact privacy@beaconnection.com. We will respond within the timeframe required by applicable law.

12.2 U.S. State Privacy Rights

California Residents. Under the CCPA/CPRA, you have the right to know, delete, correct, opt out of sale or sharing, and not be discriminated against. We do not sell your personal information as defined under CCPA/CPRA.

Virginia, Colorado, Connecticut, and Other State Residents. You may have similar rights under VCDPA, CPA, CTDPA, and other state privacy laws. Contact privacy@beaconnection.com to exercise these rights.

12.3 International Users and GDPR

Updawg and the Platform are located in the United States. If you are in the EEA, UK, or other jurisdictions with similar data protection laws, additional provisions apply, including the legal bases for processing, additional data subject rights, and information about international data transfers. Updawg acts as a Data Controller for purposes of the GDPR. For GDPR-related inquiries, contact privacy@beaconnection.com.

13. California “Shine the Light” Law

Under the California “Shine The Light” law, California residents can opt out of our sharing of their information to third parties for their direct marketing purposes. To opt out, contact privacy@beaconnection.com.

14. Children's Privacy

The Platform is not designed or intended for use by children under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe a child under 18 has provided us with personal information, contact privacy@beaconnection.com.

15. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by Updawg. We are not responsible for the privacy practices of any third-party website or service.

16. Surveys

We may ask you to participate in voluntary surveys. Survey responses may be aggregated and anonymized for analysis. If a survey requests your personal information, we will disclose that at the point of collection.

17. Changes to This Privacy Policy

We reserve the right to modify or amend this Privacy Policy at any time. If we make material changes, we will notify you through the Platform or by other reasonable means. Your continued use of the Platform after the effective date of a revised Privacy Policy constitutes your acceptance of the revised terms.

18. Electronic Records

We maintain backup files as protection against natural disasters, equipment failures, or other disruptions. Removing a record from our active files does not remove that record from backup systems. Backup data will be passively deleted as backup records are recycled.
